Update: How Can You Win? Even if you bring to light the problem of illegally peddling prescription drugs online, ads are running right next to it doing just that!

Painkiller Addiction to pharmaceuticals (especially among opioids such as OxyContin, Vicodin, Codeine, Percocet, etc.) has grown at alarming rates over the last several years in part due to the widespread availability of such substances online without prescription, even though it is a violation of the Federal Food, Drug, and Cosmetic Act to dispense prescription drugs without a valid prescription.

While there are questions regarding the providing of prescriptions online at all, we have chosen to focus on web sites that clearly indicate their intent to sell medications with No Prescription, which is an illegal activity according to United States pharmacy law. In fact, the FDA has warned that "Internet and mail-order pharmacies caught violating FDCA (Food, Drug, and Cosmetics Act) could be held criminally liable. Also, those who "aid and abet a criminal violation of the Act, or conspire to violate the Act, can also be found criminally liable." (Source) So far, 14 states have begun proceedings against physicians and/or pharmacies, and just a few days ago an "online pharmacy spammer" was sentenced to 30 years in jail for selling medications online such as hydrocodone without requiring prescriptions.(Source)

While it is unreasonable to expect all online service providers to successfully monitor and control this type of illegal usage of their services, it is frustrating to observe the inability of these providers to enforce their terms of service (eg: both GoDaddy's Registrar and Hosting TOS forbid this activity).

If you know of an unlawful site that is selling prescription drugs illegally over the internet, please consider reporting the site to the FDA. Alternatively, you can also report any suspiciously operating pharmacies to the National Association of Boards of Pharmacy. They have a "Report-A-Site" feature that can be used anonymously. In the event that you or a loved one has been harmed, please consider reaching out to your local state board of pharmacy as well. These agencies all work in concert to involve the most appropriate regulatory authorities.
